Police 'truly sorry' to Andrew Malkinson who was wrongly jailed for rape in 'grave miscarriage of justice'

Greater Manchester Police have said they are 'truly sorry' to Andrew Malkinson who was wrongly jailed for a rape in a 'grave miscarriage of justice'.

Mr Malkinson spent 17 years behind bars for a rape that he didn't commit. He had always denied carrying out the violent attack on a woman by the M61 motorway in Little Hulton in July of 2003.

But in 2004 he was found guilty by a jury and was jailed for life with a minimum term of seven years. He was then remanded in prison for a further 10 after maintaining his innocence, despite no DNA evidence linking him to the crime.

His case was referred to the Court of Appeal in January by the Criminal Cases Review Commission (CCRC), which investigates potential miscarriages of justice, after new DNA evidence was discovered.

On Wednesday (July 26), three top judges sitting at the Court of Appeal in London quashed his rape conviction 20 years later - which was greeted with cheers and applause.

Greater Manchester Police say that although they have now issued an apology to Mr Malkinson, it 'does not return the years he has lost' being jailed for the crime he never committed.

New forensic evidence coming to light in relation to the case, following developments in forensic technologies, led to the arrest of another suspect who currently remains on bail.

Assistant Chief Constable Sarah Jackson said in a public statement: "We are truly sorry to Mr Malkinson that he is the victim of such a grave miscarriage of justice, in being convicted of a crime he did not commit and serving a 17-year custodial sentence.
