The little-known council rule that smokers and vapers need to know about

A little-known council rule could see smokers in Manchester asked to stub out their cigarettes — even if they’re outside.

Licensing laws mean that cafes and bars have to apply for permission to put tables and chairs outside so customers can enjoy a drink or an al fresco meal. And a little-known rule was introduced in 2021 affecting smokers.

The rule says that you can’t light up while sitting at a table which ‘abuts’ — i.e. is next to or shares a boundary with — the pavement. However, it only applies to tobacco products, but nicotine products are exempt — so vaping is exempt from the ban.

The move means drinkers cannot smoke at popular watering holes like those on Thomas Street in the Northern Quarter nearby Stevenson Square, or King Street. However, it does not include beer gardens which are separated from the pavement — so drinkers in most pubs can smoke should they wish to.

A spokesperson for Manchester City Council said the move was introduced in light of sky-high lung cancer rates in the city. They told the LDRS: "Provisions against smoking outdoors are not a new development in Manchester, having been part of the city's licensing regime since 2021.

“Given that Manchester has one of the worst rates in England for lung cancer registrations as well as other diseases associated with smoking it is imperative that the Council takes steps to prevent people being exposed to second-hand smoke which could ultimately lead to them developing a life-threatening condition.”
